Retired racehorse charity wants NY suit dismissed

ALBANY, N.Y. (AP) - A charity that takes care of more than 1,000 retired racehorses is urging dismissal of a lawsuit by New York's attorney general, arguing its herd is doing well and its finances are sound.

The Thoroughbred Retirement Foundation filed court papers Monday that include statements from veterinarians and managers at the 25 farms around the U.S. that board its horses. It also says its audited financial statement shows total net assets of almost $7.8 million at the end of 2010.

That consists mainly of a restricted endowment from the late philanthropist and racehorse breeder Paul Mellon.

New York Attorney General Eric Schneiderman has asked the court to replace the foundation directors, saying they've made financially irresponsible decisions, leaving some animals neglected. He also wants a court-ordered inspection of the herd.
